What Is Title Insurance, and Why Should You Always Close Escrow with a Reputable Title & Escrow Company?

Buying or selling a home is one of the largest financial transactions most people will ever make. While buyers often focus on finding the perfect home and sellers concentrate on getting the best price, one of the most important parts of the transaction happens behind the scenes—the title and escrow process.

Choosing a reputable Title and Escrow company can mean the difference between a smooth closing and costly problems down the road.

What Is Title Insurance?

Unlike homeowners insurance, which protects you against future events like fire or theft, title insurance protects you against problems that already existed before you purchased the property.

Before closing, the title company performs an extensive search of public records to ensure the seller has the legal right to transfer ownership to the buyer. They look for issues that could affect ownership of the property.

These issues may include:

  • Unpaid property taxes

  • Outstanding mortgages

  • Mechanic's liens

  • HOA liens

  • Court judgments

  • Easements

  • Boundary disputes

  • Recording errors

  • Unknown heirs claiming ownership

Two Types of Title Insurance

Owner's Title Insurance

This policy protects the buyer's ownership interest in the property. It provides peace of mind that if an undiscovered title issue surfaces after closing, the owner has financial protection.

Lender's Title Insurance

If you're obtaining a mortgage, your lender will almost always require a lender's title insurance policy. This protects the lender's financial interest in the property—not the homeowner.

For complete protection, buyers should strongly consider having both an Owner's Policy and the required Lender's Policy.

What Does an Escrow Company Do?

Think of the escrow company as the neutral third party that helps everyone safely complete the transaction.

The escrow officer coordinates:

  • Holding earnest money deposits

  • Preparing closing documents

  • Collecting signatures

  • Receiving loan funds

  • Paying off existing mortgages

  • Paying property taxes and other closing costs

  • Recording the deed

  • Distributing funds after recording

The escrow company ensures that no one gets paid and ownership doesn't transfer until every condition of the contract has been satisfied.
