📜 1. National REALTOR® Code of Ethics (What Arizona REALTORS® Must Follow)

All REALTORS® — including those in Arizona — voluntarily agree to abide by the NAR Code of Ethics & Standards of Practice, which includes:

🔹 Preamble

• Sets out the aspirational ideals and ethical principles REALTORS® should uphold, such as honesty, integrity, fairness, and service to the public.

🔹 Duties to Clients and Customers

• REALTORS® must protect and promote clients’ interests above their own.

• Provide competent and diligent services.

• Disclose all material facts about properties, within legal limits.

🔹 Duties to the Public

• REALTORS® must treat all parties fairly.

• They may not discriminate in providing real estate services based on race, color, religion, sex, disability, familial status, national origin, sexual orientation, or gender identity.

REALTORS® must not engage in harassment based on those protected characteristics.

🔹 Duties to Other REALTORS®

• Cooperation with other REALTORS® is expected unless it conflicts with the client’s best interests.

• Respect and honesty in all professional interactions.

🔹 Standards of Practice

The Code includes numerous standards of practice that clarify ethical duties — for example:

• Disclosing compensation arrangements and brokerage policies.

Ensuring contracts and agreements are clear and in writing.

📚 2. Arizona REALTOR® Enforcement and Requirements

✅ Ethics Training

• REALTORS® in Arizona must complete NAR-approved Code of Ethics training at least once every three years as a condition of maintaining REALTOR® membership (these are real estate professionals who are members of NAR and state/local REALTOR® associations).

🧑‍⚖️ Enforcement

• Ethical complaints against a REALTOR® are adjudicated by the Arizona Association of REALTORS® (or the local board), not the Arizona Department of Real Estate.

Penalties for ethics violations may include:

• Additional ethics education

• Reprimand

• Fines

• Suspension or termination of REALTOR® membership (but not suspension of a real estate license itself — that’s governed by the state licensing agency).

❗ Important Distinction

• A real estate agent or broker who is not a REALTOR® (i.e., not a member of NAR or an association) is not subject to the NAR Code of Ethics — only the licensing laws and regulations of Arizona.
